LAWYER4MUSICIANS 2010 SHOWCASE WAS ACES!!!

If any of you read my ramblings you or are fans of any of my clients, you already know that we had our second annual showcase in Austin last week.  Our showcase is a way to promote our clients and let the music community know that not all lawyers suck.  We at L4M strive to help artists (not just musicians) treat their art as a business.  We routinely help protect work product, form entities for bands, review and draft label and license agreements and, overall, act as the left brain aide to right brain thinkers.  Our showcase is just a way to get that across to a wider audience and to thank our current roster of clients.  NOW ON TO THE SHOW:

It is now Wednesday, March 24, and I have still not completely recovered from our showcase which took place on Saturday, March 20.  To say that it was an amazing show is a huge understatement.  Obviously I am a bit biased, but our lineup which included You, You’re Awesome, French Horn Rebellion, Hey Champ, Kidz in the Hall, Bad Rabbits, 88 Keys, Cool Calm Pete, The Cool Kids and Rakaa actually got better on the day of the show!  Travis McCoy dropped by to perform a new song with 88 Keys, Tenille blessed us with her vocals on a couple of Cool Kids’ tracks and The Alchemist and Evidence reunited with their Dilated Peoples mate Rakaa to take the show to the next level.

None of this could have been possible without the amazing work and dedication of CATHARSIS NYC.   Thanks to Justin Kim, James Kim and Tonia Kim (no relation) who put on yet another seamless show.  All of the artists were amazed at their efficiency and organization in running such a giant event.  Several commented that it was the best show they played for the entire showcase.  If you are even thinking of hosting an event, you need to contact them at business@catharsisnyc.com.

More kudos goes to our firm of Stahl Cowen.  If you become a client of ours, you are a client of theirs.  Without Stahl Cowen’s support, there would be no show.

Finally, thanks to the newest members of L4M, Eric Malnar and Brian Troglia.  Both of my partners have made L4M bigger and better by bringing their unique music industry and legal experience to the team.  Watch for new entries and articles from both of these guys.

Austin, We Are on Our Way!

The L4M team is en route to Austin, Texas.  We are geared up for a week of great music, networking and learning about how the music industry continues to morph.

HALLELUJAH!!! SECTION 181 PASSES THE SENATE!!!

We can all be like Kool and the Gang and C-E-L-E-B-R-A-T-E- good times, come on.

 

More than three months after the House passes a version of the Tax Extender Bill of 2009 (HR 4213), the Senate got off its collective rear end and passed a modified and heavily pork filled version of the Bill today.  By a vote of 62 to 36 this persistent piece of legislation made it one step closer to becoming law (remember it still needs the President’s signature).  Of importance to all of us, the Extender Bill contains a one year extension of Section 181.  All film makers and investors may now breathe a collective sigh of relief.

Now that the extension is a whisker away from becoming law, all you film makers can start approaching investors and their confused accountants to tout the extradorinary tax incentive that is Seciton 181.  Remember the tax dedcution that 181 offers is against passive income (although there are subtle nuances that allow active investors to take the deduction against active income).  Also, musicians, videographers, web casters, 181 can be used for all qualifying films; which is to say it is not just for feature length films. 

We at L4M routinely work with film makers in planning and drafting their film investment documents.  Now with the help from our intrepid Senators, we can once again add language to these documents regarding Section 181 (and State tax credits) that make film investment a bit more attractive.

Now that 181 has passed, stay tuned for other development in film and music law.  Thanks for reading and for all of your input.





Is Section 181 Still Alive?

The answer is yes, but barely.  The Senate is “discussing” H.R. 4213 which contains the now familiar extension of Section 181.  Section 117 of the bill which has passed the House would extend 181 to the end of 2010.  There is no guidance for how to treat the past 3 months, but we will worry about that when we get this extension past the Senate and on to Obama.

The Senate, per Senator Reid are actively discussing and negotiating the passage of the current version of the 2009 (now 10) Tax Extender Bill today.  No one ever said government move swiftly.  You can track the bill here:  HR 4213.

First off, thank you to all of the bands and musicians who submitted to the L4M Showcase opener.  After the fun task of listening to some great music and reading interesting facts about a ton of bands, we had to make a decision.  It was not an easy task, but when we heard this Ohio duo’s interesting take on electro-pop, we knew we had our winner

Without further ado, say hello to this year’s opening band:  You, You’re Awesome.  Not just a fun name, these talented musicians promise to get the party started out right.  Check them out:
